Court sentenced minor in abortion case: 10-10 years imprisonment, also fined 20,000 and 30,000 rupees

In Sonbhadra, 7 years ago, the court delivered its verdict in the case of a 15-year-old minor having an abortion without consent. Hearing on Tuesday, the Niharika Chauhan Court, found guilty and sentenced the culprits Suresh Kumar Yadav and Mamta Maurya to 10 years imprisonment and a fine of 20 thousand and 30 thousand rupees respectively. Failure to pay the fine will result in an additional jail term of 6-6 months. At the same time, half of the amount of the fine of Rs. 25,000 will be released to the victim.
2015 was the case
According to the prosecution, a person living in a village in the Kon police station area alleged in the Tahrir given to the Duddhi police station on June 16, 2015 that his 15-year-old minor daughter, Suresh Kumar Yadav, son of the village from Kachnarwa district of Kon police station, and one of his companions lied and took him to Daya hospital at 8 p.m. on June 15, 2015, telling him that he needed to seek treatment. Where, without the girl’s consent, Mamta Maurya’s wife, Daya Shankar Maurya, along with her husband, aborted the 7-month-old child. When Daya arrived at the hospital on information, the girl was lying unconscious and the dead child was also lying next to her.
6 additional months in prison for non-payment of fine
On this complaint, the police registered an FIR and opened an investigation into the matter. Later, it was found that the incident happened in the Kon police station area. After registering him at the Kon police station, the investigation into the case began. After obtaining sufficient evidence, the investigator filed an indictment against Suresh Kumar Yadav and Mamta Maurya in court.
During the hearing of the case, the court, having heard the arguments of the lawyers of both parties, having read the statements and files of the witnesses and found them guilty, sentenced the convicts Suresh Kumar Yadav and Mamta Maurya to 10 years imprisonment and 20 thousand and 30 thousand rupees respectively. Failure to pay the fine will result in an additional 6 months imprisonment.
The period spent in prison is included in the sentence. The victim will receive half of the amount of the fine of 25,000 rupees. Public Prosecutor Satya Prakash Tripathi and Neeraj Kumar Singh’s lawyer pleaded on behalf of the prosecution.
