Washington. In a big relief for foreign workers working in the US tech sector, a judge has ruled that spouses of H-1B visa holders can work in the US. US District Judge Tanya Chutkan denied a motion filed by Save Jobs USA. In which a request was made to reject the regulation of former President Barack Obama’s tenure. Under this regulation, work authorization cards are issued to spouses of certain categories of H-1B visa holders.

Tech companies such as Amazon, Apple, Google and Microsoft have opposed the lawsuit. Under these regulations, the United States has so far granted employment rights to the spouses of nearly 100,000 H-1B workers, many of them Indians. Judge Tanya Chatkan said in her order that Save Jobs USA’s first argument is that Congress has never authorized the Department of Homeland Security to allow foreign nationals such as H-4 visa holders to work while are in the United States. The judge said Congress expressly and deliberately authorized the US government to make employment a condition of the H-4 spouse’s stay in the United States.

Good news for H-1B visa holders, spouses will automatically get work approval

Judge Chatkan dismissed the lawsuit filed by Save Jobs USA, saying the Department of Homeland Security authorized employment not only for students, but also for spouses and dependents of H-1B visa holders. The judge wrote in his decision that apart from that, the Department of Homeland Security gave the right to work to the spouses of foreign officials and the spouses of employees or leaders of international organizations. Ajay Jain Bhutoria, a prominent leader of the Indo-American community and member of the commission, welcomed the judge’s decision. American companies employ foreign workers, especially in the technology sector, via H-1B visas.
