US relaxes green card rules ahead of PM Modi’s visit, it will help

Just ahead of Prime Minister Modi’s all-important visit to the United States, United States Citizenship and Immigration Services (USCIS) released new guidelines regarding eligibility criteria for initial and renewal document applications. Employment Authorization (EAD), which can lead to a green or permanent card. Indian IT professionals applying for residency should be of great help.
The green card is officially known as the permanent resident card. It is a document issued to immigrants to the United States as proof that the bearer has been granted the privilege of permanent residence.
The Immigration Act provides for the issuance of approximately 140,000 employment-based green cards each year. However, each year only seven percent of these green cards can be awarded to people from any country.
Easing in new green card guidelines
The new USCIS guidelines outline certain requirements applicants must meet to be eligible for an initial EAD based on extenuating circumstances. These include being the primary beneficiary of an approved Form I-140, having legal nonimmigrant or grace period status, not filing an adjustment of status petition and meet certain biometrics and criminal history requirements.
USCIS also exercises its discretion to determine whether an applicant meets compelling circumstances warranting the issuance of employment authorization.

Ajay Bhutoria, a prominent Indian-American community leader and immigrant rights advocate, said: “These measures are an important step in helping people facing difficult circumstances and ensuring their ability to work legally in the United States. ” ‘
He says the non-exhaustive list of eligible circumstances gives people the opportunity to present evidence to support their case. “For example, individuals with approved immigrant visa applications in oversubscribed categories or fee-paying territories may demonstrate compelling circumstances by presenting evidence such as school or college enrollment records, mortgage documents or long-term lease records,” he added.
Bhutoria says this provision could prove important in situations where families are forced to return to their home countries due to the potential loss of their homes, dropping out of school or losing jobs.
